HIGHER EDUCATION ACCREDITATION A U.S. district judge rejected a challenge by the state of Florida to the constitutionality of the accreditation system for colleges and universities. The system plays a critical role in higher education because schools must be accredited for students to receive federal financial aid. Florida alleged, in part, that the federal government delegates too much authority to private accrediting agencies. The judge granted the federal government’s motion to dismiss the case, finding that the state’s case used legal standards that were not relevant to the case.

2 LIVE CREW A Florida federal jury ruled that the Miami rap group 2 Live Crew is entitled to the copyrights on dozens of songs, finding the group made a valid claim under a law that allows them to claw back ownership of their music after more than three decades.

STAND YOUR GROUND APPLICATION A Florida appeals court has ruled that the “Stand Your Ground” law applies to cases involving animals. A man faced charges, including animal cruelty, after he shot a pit bull that threatened him and his Chihuahua. The court stated that deadly force can be justified against animals if there is a reasonable belief of imminent danger.

CAMPAIGN FINANCE CRIME Former Florida Senator Frank Artiles (R-Miami) was found guilty of campaign finance and voter registration violations on September 30th in a trial that showed the underbelly of Florida politics. It took a Miami-Dade jury just over six hours to reach a unanimous verdict in a case involving political operatives and a “ghost candidate” who likely tipped a tight election. Artiles was found guilty of excessive campaign contributions, conspiracy to commit excessive contributions and falsely swearing an oath, all of which are felonies that could carry five-year sentences. Sentencing has been set for November 18th.

RANDY FINE A Brevard County judge has ordered Representative Randy Fine (R-Palm Bay) to attend an anger management class and pay a $100 fine as a result of his actions during a court hearing on election paperwork. During the virtual hearing, Fine made obscene gestures. Fine will appeal the ruling.
